Please join FordHarrison attorneys Johanna G. Zelman and Cindy M. Cieslak for a complimentary webinar to discuss difficult issues employers may face during a presidential election. This year's election has been particularly controversial, and has created debate and divide throughout the country which has spilled over into the workplace. Employers often wonder whether they can prohibit employees from discussing political issues in the workplace, or discipline an employee who causes disruption through politically-motivated speech. It is well-known that public sector employers are bound by the confines of the First Amendment; less known is that private sector employers may also be subject to similar restrictions based on state and federal statutes.

In examining these laws, this webinar will cover topics including:

  • The First Amendment
  • State statutes applicable to private and public-sector employers with prohibitions similar to those of the First Amendment 
  • Controlling politically-motivated speech and conduct in the workplace 
  • Addressing employees who engage in politically-motivated speech and conduct 
  • Off-duty vs. on-duty politically-motived speech and conduct of employees
  • Disciplining an employee when his/her politically-motivated speech and/or conduct becomes disruptive
  • The interplay of politically-motivated speech, conduct and affiliation with other labor and employment laws
