About the Program
Employers regularly utilize criminal and credit history information to screen candidates for employment and assist with difficult hiring decisions. To do so, however, they must navigate an ever increasing (and confusing) web of federal, state, and local laws regulating employer rights to obtain such information. Employers often fall victim to the complexities of these laws and find themselves subjected to expensive litigation and statutory penalties for inadvertent violations. As we approach 2018, employers should familiarize themselves with recent developments in this area, including an update on Fair Credit Reporting Act compliance and claims, state-specific “Ban-the-Box” rules and regulations, and recently enacted state laws prohibiting employers from requesting salary information during the application process.
