About the Program
The National Labor Relations Board has been busy this past year reversing precedent and forging new law. Everything indicates that the Board intends to maintain, if not increase, its pace of changing the law to facilitate union organizing and to expand the impact of the NLRA to all employees, not just those represented by a union. Just recently the Board has issued decisions that (1) deemed confidentiality and non-disparaging clauses in settlement/severance agreement unlawful and (2) expanded the remedies it can award against an employer.
